As you know by now, The No Surprises Act, enacted in 2020, outlawed so-called surprise medical billing and instituted an independent dispute resolution (IDR) system to resolve disputes between plans and out-of-network providers. But IDR is now rife with abuse by certain providers who have overwhelmed the system with costly disputes. This, in turn, has led to even higher health care costs.
Newly proposed rules governing IDR will not be enough to fix the problem. Ultimately, legislation will be needed. But unfortunately, one prominent bill – the No Surprises Act Enforcement Act (H.R. 4710/S. 2420) – would only make the problem worse.
