Five years after the enactment of the No Surprises Act – the measure intended to prohibit “surprise” medical billing (the unexpected charges patients see when they inadvertently or unexpectedly receive care from an out-of-network provider) – the “cure” has proven almost as harmful as the disease.

In the latest edition of Just a Minute!, Council President Katy Johnson explains how some health care providers are abusing the law’s arbitration process, raising costs throughout the health care system. The Council continues to work to educate policymakers – and now federal courts – on the unintended consequences of the law.
